This Digital Millennium Copyright Act (DMCA) Notice outlines the process for submitting copyright infringement claims related to content displayed on the Precise Realty Group website ("Site"). We will respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA").

    3. FILING A DMCA NOTICE OF INFRINGEMENT

    If you believe that any content on this Site infringes your copyright, you may submit a notification of claimed infringement ("Takedown Notice") to our Designated Copyright Agent. To be effective under the DMCA, your Takedown Notice must include the following information in writing:

    • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
    • Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved)
    • Identification of the specific material on this Site that is claimed to be infringing, including the URL or other specific location so we can locate the material
    • Your contact information, including your full name, mailing address, telephone number, and email address
    • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
    • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner

    4. COUNTER-NOTIFICATION

    If you believe that your content was removed or disabled from this Site as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. To be effective, your counter-notification must include:

    • Your physical or electronic signature
    • Identification of the material that was removed and the location at which it appeared before removal
    • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
    • Your name, address, telephone number, and email address
    • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which Precise Realty Group may be found) and that you will accept service of process from the person who provided the original Takedown Notice

    5. REPEAT INFRINGERS

    In accordance with the DMCA, Precise Realty Group maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. We may also, in our sole discretion, limit access to the Site and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

    6. GOOD-FAITH SUBMISSIONS

    Please note that Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. Before submitting a Takedown Notice or counter-notification, ensure that you have a good-faith basis for your claim.

    7. RESPONSE TIME

    Precise Realty Group will make every reasonable effort to review and respond to valid DMCA notices within 10 business days of receipt. Upon receiving a valid Takedown Notice, we will remove or disable access to the allegedly infringing material and make a good-faith effort to notify the user who posted the material. Upon receiving a valid counter-notification, we may restore the material within 10 to 14 business days unless our Designated Copyright Agent first receives notice from the copyright owner that they have filed an action seeking a court order to restrain the alleged infringer.

    10. CHANGES TO THIS NOTICE

    We reserve the right to update this DMCA Notice at any time. Changes will be posted with a new "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Notice.
